The material appearing on the websites facebook.com/misslim.mandarin, https://malaysiamandarin.com, https://mama.malaysiamandarin.com and miss-lim-mandarin.mykajabi.com, (“this Site”), is provided as either information about Miss Lim’s events, people, MAMATM(“the Program”) and stories as a platform for online connection and community. The owner of this Site (Miss Lim.Mandarin) and its directors, agents, employees and affiliates assume no responsibility or liability for any consequences resulting directly or indirectly from any action or inaction you take based on the information found on or material linked to on this site.
Any information by or on this Site is provided for promotional or informational purposes only and is not to be relied upon as a professional opinion whatsoever. By using this Site, you accept and agree that following any information or recommendations provided therein is at your own risk.
The following terms and conditions form a binding agreement (“Agreement”) between you and Gigs Connect, a company incorporated in Petaling Jaya, Malaysia. Miss Lim.Mandarin and her team may modify, amend, supplement and replace these terms and conditions at any time without advance notice. Your continued use of this Site after any change means you have accepted the changed terms and conditions.
Copyright.
Copyright laws Copyright Act 1987 protect all materials created by Miss Lim.Mandarin and her team on the Site as original works. All materials belong to Gigs Connect, including those with the absence of a registered copyright symbol. Any infringement may receive Legal Notice of Demand from our lawyer.
Masterclass.
We reserve the rights for selection of participants to join our free masterclass. If the participants are not informed or received our invitation means you're not selected. We are not obliged to inform for any participants who are not successfully selected. All selection criteria and process are internal and will not be disclosed.
Links to Third Party Websites.
This Site may contain links to third-party websites. Any linked sites, materials, and pages are not under the control of Gigs Connect. Gigs Connect or Miss Lim.Mandarin is not responsible for the content contained in any related website, nor for any losses or damages you may incur due to the use of any such website. Gigs Connect or Miss Lim.Mandarin accepts no liability for any errors or omissions contained in third-party websites. We provide these links to improve your use of the Site, enable you to connect with Miss Lim on various platforms, and help Miss Lim.Mandarin offer the most accessible services for you and conduct transactions.
Intellectual Property Ownership
If we have materials on the Site which you can download, a revocable, non-exclusive license is granted for you to download copies of the materials for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- share or transfer the materials to another person or “mirror” the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Gigs Connect or Miss Lim at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
If Miss Lim.Mandarin and her team discovers that you have illegally misappropriated or used any of the intellectual property you were granted access to, you will be blocked from any future programs and will seek any extent of legal remedies and you will be required to cover all legal fees necessary to enforce these rights.
Testimonials
We love to share our students’ wins and successes from inside our programs. By signing up for the Program, you grant Miss Lim.Mandarin or MAMATM permission to use any testimonials in our marketing materials and/or any promotional efforts. This includes but is not limited to unofficial testimonials, words of praise via Instagram stories, public posts or posts inside our Facebook groups, and direct messages with Miss Lim.Mandarin. We will blur full names and photos (if requested) on screenshots used, and you understand that all confidentiality provisions apply and that testimonials are the only exception to our confidentiality obligations.
Payment
1. Full Payment.
The definition of full payment is to pay the entire price of the course by 1-time online transfer. Separate payment or instalments are not considered as full payment. Full payment bonuses may vary from case-to-case basis which is based on the day of masterclass that you attended. Due to the digital nature of the bonuses provided, they are no refunds or exchange to other materials or services.
2. Payment Plans.
If you opt for a payment plan, upon executing this agreement, you agree to pay the Company the full remaining balance, but just to pay by 3 or 6 monthly instalments. For instalments, customers use the Buy Now Pay Later (BNPL) companies' services to pay the instalments which are 3rd party companies which are not in any of our control. Therefore, BNPL companies are responsible for the collection, cease or change on the payment and our company is only responsible to provide the learning materials and lessons as mentioned for the said package. Customers may not threaten or blame our company for any actions taken by the BNPLs including late payment penalties, calls, messages, or any other penalties. We may not provide any refunds or compensation if the Customers have change of minds, personal issues, or any other reasons that decide to stop the instalments from charging. The only possible refund please refer to Our Refund Policy. If Customers decided to stop the MAMATM course, this will only lead to not be able to access to our materials and lessons, and it does not mean it will stop the instalments from charging.
3. All Payment is Not Refundable
All the payment you’ve made to Gigs Connect is not refundable including but not limited to lock price or deposit, purchase on our MAMATM course or any other products. All digital and downloadable products are non-refundable and non-exchangeable. Unless of MAMATM course with a 14-day refund policy.
Our Refund Policy
We want you to be 100% satisfied with the program, but we also want to ensure our students have given the course a fair shot and have used their best effort to apply the methods and strategies. Refund policy only applies to MAMATM course. Please contact our support team through WhatsApp +601126383280 within 14 days of your purchase to qualify for a refund. The time counts at the moment you have received portal login details. We follow a ‘Do The Work’ Refund Policy which means you must include ALL required, completed coursework or quizzes with your request for a refund. If you request a refund and do not include all required coursework or quizzes by your 14th day, your refund will not be accepted. If the package you purchased has 1on1 coaching, the use of 1on1 coaching will waive your right to refund. If you purchased with an instalment, the maximum refund amount will be the instalment part excluding the deposit money. We do not accept the reason of being busy, poor health condition or financial issue after purchase of MAMA Course. We only accept refund based on the quality of the course content and its method of learning, else other reasons will not be accepted and not eligible for refund. All refunds are discretionary as determined by our management.
1. Example of No Refund.
An example of a situation where we wouldn’t grant a refund is if a student doesn’t put in any effort, doesn’t try at our courses, doesn’t take full responsibility for their own learning journey, and then asks for their money back. We also do not offer refunds for the following: (1) attempts to use the refund policy as a way to opt-out of any existing financial obligation and/or payment plan already committed to us upon signing up for our course, (2) change of mind or lose of interest after purchasing the course, and/or (3) inability to complete the course, and/or (4) exceed the 14th day upon getting the portal login details.
2. Example of Granted Refund.
An example of a situation where Company would give a refund is if Customer completed the entire course, tries their best, shares with us what they learned, and then provides an objectively fair reason why Client wants their money back. This means Company expects the following task(s) to be completed before requesting a refund:
- Complete entire first 2 modules including all quizzes and video lessons
Customers/ Students
We reserved the rights to accept our students to join our course or teaching or any other services. We will not disclose the selection process. If customers made payment without our prior notice, we may reserve the rights for not refunding. Even if customers made payment with our prior notice, we reserves the rights not to accept the customers/ students later and refund on the payment made with deduction on the products/ services had been provided. We also reserve our right to cancel and refund to the students should we feel that our course is not right for them.
Blocklist
Miss Lim.Mandarin and its team retain the right to ‘Blocklist’ you from accessing all materials, courses, or other products or services we offer in the event you steal any of our intellectual property or misuse our course or material for purposes that may damage our reputation and/or unbeneficial to Gigs Connect/ Miss Lim.Mandarin/ MAMATM. We will remove the student from the blocklist once the student is proven innocent, Gigs Connect reserves all the rights on any decisions.
Students or Customers Responsibilities
"Students" or "Customers" refer to people who made payment to Gigs Connect for MAMATM Course. Students or Customers is responsible but not only limited to keep in mind of clearing the balance to book a slot for live sessions, clearing the balance to obtain the MAMA portal access, the expiry date of the portal and related services, enquire when a thing/ status is unclear. The above responsibilities fall under Students or Customers, and will not to hold Gigs Connect, Miss Lim.Mandarin and the team accountable for reminding or informing.
Certification
Gigs Connect will only grant the certificate to the student who took MAMATM final assessment. The student can take the final assessment within the period set by Gigs Connect. All the markings regarding the final assessment are internal and not disclosed to any student. Only the results will be disclosed to the student. All results disclosed are final and no appeal is allowed. However, the student is allowed to retake the final assessment with a fee of RM 100 (for final assessment only). The certificate will only be provided through online as PDF format.
Materials and/or Services
Our company provides materials and services based on the package purchased by the customer. The materials and services provided are on a batch-to-batch basis, which means that they may differ from one masterclass offer to another. The materials provided by our company are for personal use only and may not be shared, distributed, or sold without prior written permission. Any unauthorized use of our materials may result in legal action. Videos in the MAMA portal are not allowed to download with whatsoever reason. Materials and/or services are not mentioned during the masterclass or not written in the email is not eligible to claim with whatsoever reason. The weekly webinar will be the exactly same format as the free masterclass attended. The eligibility to get lifetime portal access is determined by two main factors: final assessment obtain band 5 or 6 and the appropriateness to fit into the group which is wholly determined by our management team.
Freezing
Freezing of account means freeze the MAMA learning portal, this results in can't access to the portal temporarily and the access duration is no longer counting until being unfrozen. For example, the access duration is 100 days left upon request of freezing, so your portal access duration will remain unchanged until the portal is unfrozen. Freezing is only allowed once. This freezing is totally not related to payment plans or refunds. Do not confuse this freezing as stopping instalments or we provide any refunds. This freezing will not stop the 14-day money-back guarantee from counting since the day received MAMA portal login details.
No Guarantees
We make NO GUARANTEES about any success that you’ll get from our Site or our courses or any of our free offers. We will do everything for you to be able to speak Malaysia Mandarin fluently, but we make no guarantees since we try our best but can only control so much about your success through our courses. You understand that Miss Lim.Mandarin/ Gigs Connect/ MAMATM makes no guarantees whatsoever regarding any results based on any action or inaction relating to your fluency of Mandarin speaking and/or Mandarin knowledge based on the information we share or services we sell or share for free through the Site. Ultimately, we will not be responsible or make any promises for what will happen in your life. Even if you’ve worked with us as a client before and had certain results, we make no guarantee that they will happen again. We cannot be any more clear about this: We are here for you and want you to succeed in Mandarin speaking, but we make no promises regarding results and make no guarantees whatsoever.
Complaint, Claim, Accusation, Slander, Infringement
Any complaints, or so-called claim of customer rights, or accusation or slander or infringement, we will resolve the issues through legal approach. Lawyers and/or police may involve in process of resolving the issues until our side is satisfactory with the final decision or outcome. We reserve all the right to keep the chats, voice messages, photos, videos, calls, or any written or verbal form of proof as evidence in court.
Entire Agreement
These terms and conditions and any other legal notices, policies and guidelines of Gigs Connect linked to these terms and conditions or contained on this Site constitutes the entire Agreement between you and Gigs Connect relating to your use of this Site and supersedes any prior understandings or agreements (whether oral or written), claims, representations, and understandings of the parties regarding such subject matter. This Agreement may not be amended or modified except by Miss Lim.Mandarin or Gigs Connect.
Site Terms of Use Modifications
Miss Lim.Mandarin or Gigs Connect may revise these terms of use for its website at any time without notice. By using the Site, you are agreeing to be bound by these Terms and Conditions of Use.
Limitation of Liability and Indemnity
In no event shall Miss Lim.Mandarin or its affiliates be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to view or use the materials or content on the Site, even if Miss Lim.Mandarin/ Gigs Connect/ MAMATM has been notified orally or in writing of the possibility of such damage.
As a condition of your use of the Site, you hereby indemnify Miss Lim.Mandarin, Gigs Connect and its directors, agents, employees, and affiliates from and against any and all liabilities, expenses (including legal fees) and damages arising out of claims resulting or arising from your use of this Site.
